1. Agreement to these terms
These Terms of Service (“Terms”) are a binding agreement between you and Nayvelle (“Nayvelle”, “we”, “us”), which operates the social network at nayvelle.club, its progressive web app and related services (together, the “Service”).
By creating an account or using the Service you accept these Terms, our Privacy Policy and our Community Guidelines, which form part of these Terms. These Terms are published in accordance with rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“IT Rules”). If you do not agree, do not use the Service.
2. Who can use Nayvelle
To use the Service you must:
- be at least 18 years old and legally able to enter into a contract under the Indian Contract Act, 1872 (or the law where you live);
- not be barred from using the Service under any applicable law, or previously banned by us;
- provide accurate sign-up information and keep it up to date;
- hold only one personal account, which you may not sell, transfer or let others use.
Nayvelle is not directed at children. If we learn that an account belongs to someone under 18, we will close it and delete its personal data, consistent with section 9 of the Digital Personal Data Protection Act, 2023 (“DPDP Act”).
3. Your account and security
You are responsible for activity on your account and for keeping your password confidential. Use a strong, unique password and review your active sessions in Settings → Account & Security. Tell us immediately at support@nayvelle.club if you suspect unauthorised access.
Your handle must not impersonate another person, brand or organisation, or mislead people about who you are. We may reclaim handles that infringe trademarks or are held inactive solely to squat on them.
4. Your content and the licence you give us
You own what you post. Photos, videos, stories, messages, files and other content you share remain yours. To run the Service, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, transcode, resize and display your content only to the audience you choose (Public, Contacts, Close Friends, Private, or the members of a group, event or page) and only for the purpose of operating and improving the Service.
We do not use your content for advertising, we do not sell it, and we do not license it to third parties to train artificial-intelligence models. The licence ends when you delete the content or your account, except for copies others have legitimately re-shared within the Service, residual backups that are purged on their normal cycle, and information we must retain by law (see section 11).
You confirm that you have the rights needed to post your content and that it does not violate these Terms, the Community Guidelines or the law.
5. What you must not share or do
In line with rule 3(1)(b) of the IT Rules, you must not host, display, upload, modify, publish, transmit, store, update or share any information that:
- belongs to another person and to which you have no right;
- is obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on the grounds of religion or caste with the intent to incite violence;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads about its origin, or knowingly and intentionally communicates misinformation or information that is patently false and untrue or misleading in nature;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents the investigation of any offence, or is insulting another nation;
- contains software viruses or any other code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
- is in the nature of an online game that is not verified as a permissible online game, or advertises or promotes an online game or intermediary offering it that is not permitted;
- violates any law for the time being in force.
You also must not:
- scrape, crawl or bulk-collect data about other users, or use automated means to create accounts or interact;
- probe, scan or test the vulnerability of the Service except through responsible disclosure to safety@nayvelle.club;
- circumvent audience settings, blocks, rate limits or other privacy and safety controls;
- send spam, run engagement-manipulation schemes or sell accounts, followers or reactions;
- use the Service for unlawful commercial solicitation or to sell regulated goods.
6. How we moderate
Nayvelle has no engagement-maximising algorithm and does not read private messages for advertising. We act on content when it is reported to us by users, when we receive a lawful order, or when automated integrity checks (for example, known-malware or spam signatures) flag it.
- We may remove or restrict access to content, add a sensitive-content screen, limit features, or suspend or terminate accounts that break these Terms.
- On receiving actual knowledge through a court order or notification from an appropriate Government agency under section 79(3)(b) of the Information Technology Act, 2000, we remove or disable access to the unlawful information within 36 hours, as required by rule 3(1)(d) of the IT Rules.
- Where we act on your content on our own initiative, we tell you why and how to dispute it, unless the law or an ongoing investigation prevents that.
- We periodically, and at least once a year, remind users of these rules and of the consequences of breaking them, as required by rule 3(1)(c).
To contest a decision, reply to our notice or contact the Grievance Officer. Complaints are acknowledged within 24 hours and resolved within 15 days.
7. Groups, events and pages
If you create a group, event or page, you are responsible for how you run it, including the rules you set and the moderators you appoint. Owners and admins must enforce these Terms within their spaces and may not use them to coordinate violations. Deleting a group, event or page you own deletes the content members posted inside it; warn members before doing so.
8. Nayvelle Pro, stickers, boosts and payments
Nayvelle is free to use. Optional paid features (such as Nayvelle Pro, sticker packs and post boosts) are described with their price in Indian Rupees, inclusive of applicable taxes, before you pay. Payments are processed by our payment partners (Razorpay or Stripe); we never see or store your full card or UPI details.
- Digital purchases are delivered to your account immediately on successful payment.
- Subscriptions renew only if you explicitly opted into renewal, and you can cancel any time; cancellation takes effect at the end of the paid period.
- If a purchase fails to deliver, or you are charged twice, contact support@nayvelle.club within 30 days for a refund to the original payment method. Consumer rights under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 are not affected.
- Boosts make a post more visible to people who already can see it under its audience setting. Boosts never override privacy settings and never use personal data for targeting.
- Founder or promotional codes have no cash value and may not be resold.
9. Copyright and trademarks
Respect other people’s intellectual property. If you believe content on Nayvelle infringes your copyright or trademark, send the Grievance Officer the work concerned, the location (link) of the infringing material, your contact details and a statement that you own or are authorised to act for the rights holder. We act on valid notices in accordance with section 52(1)(c) of the Copyright Act, 1957 and the Copyright Rules, 2013. Repeat infringers lose their accounts. The Nayvelle name, logo and wordmark are our trademarks.
10. Leaving Nayvelle, suspension and termination
You can download your data or permanently delete your account at any time from Settings → Privacy & Visibility → Your data rights. Deletion removes your profile, posts, stories, media, messages you sent, and spaces you own from the Service immediately.
We may suspend or terminate your access if you seriously or repeatedly break these Terms, if required by law, or to protect users or the Service. Where reasonable we will give notice and a chance to respond first.
11. Information we must keep
Rule 3(1)(h) of the IT Rules requires us to retain information collected for your registration for 180 days after your account is deleted or withdrawn, and rule 3(1)(g) requires us to preserve removed information and associated records for 180 days (or longer if a court or authorised agency requires) for investigation purposes. This retained information is held securely, is not visible to anyone on the Service, and is used only to comply with lawful requests. We provide information or assistance to authorised Government agencies only on a lawful written order, and no later than 72 hours after receiving it, as rule 3(1)(j) requires.
12. Disclaimers and limitation of liability
We work hard to keep Nayvelle available and secure, but the Service is provided “as is” and “as available”. We do not guarantee it will be uninterrupted or error-free. Content posted by users is their responsibility, not ours; as an intermediary under section 79 of the Information Technology Act, 2000, we are not liable for third-party information we host, provided we observe due diligence.
To the extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or ₹1,000. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or gross negligence.
13. Governing law and disputes
These Terms are governed by the laws of India. Before going to court, please let us try to resolve the problem through the grievance process. Subject to that, and to any right you have to approach a Grievance Appellate Committee, the Data Protection Board of India or a consumer commission, the competent courts in India have exclusive jurisdiction.
14. Changes to these terms
We may update these Terms to reflect changes in the law or the Service. For material changes we notify you in the app and by email at least 15 days before they take effect, unless the change is required sooner by law. The effective date at the top always shows the current version. If you keep using Nayvelle after a change takes effect, the updated Terms apply; if you disagree, you can delete your account.
